Research Project #1
After completing all tasks assigned in Week 1, analyze the following scenarios by publishing a short answer response for 1a, 1b, 1c, 2, and 3.
Instructions
1. Each response requires a scholarly source from ProQuest or a primary authority from LexisNexis (paralegal and legal studies students)
2. A properly formatted and embedded citation is required for each response, as required by Bluebook (paralegal and legal studies students)
3. Use the Instructional Materials Module and “Grading Criteria” below to meet all expectations for 100%
4. Submit one DOC for all responses (refer to the “Submission Guidelines” below)
Scenarios
1. Analyze the following situations and determine whether the federal court has jurisdiction under diversity of citizenship.
a. Brady and Jeffers, both citizens of North Dakota, wish to sue as a result of an automobile accident caused by the negligence of Crane, a citizen of Montana. The damages for each of them exceed $75,000.
b. Same as in (a) except that Brady and Jeffers also want to name as a defendant, Dowd, the owner of the vehicle driven by Crane. Dowd is a citizen of North Dakota.
c. Same as in (a) except that Brady is claiming damages of $50,000 and Jeffers is claiming damages of $40,000.
2. Digicam, Inc., a manufacturer of digital cameras, is a corporation incorporated in the state of Delaware with its principal place of business in California. It distributes its product through several national retailers that do business in several states, including Washington State. Reider, a citizen of the state of Washington, buys a defective camera that “explodes” while Reider is holding it, injuring Reider. The retailer who sold Reider the camera has declared bankruptcy. Reider wishes to sue Digicam, Inc. for his injuries. Reider is claiming that his damages exceed $75,000. Based on the facts given, would the state of Washington have personal jurisdiction over Digicam?
3. Review the map in Exhibit 2-4 in Chapter Two. If the Digicam, Inc. case from Question 2 was tried in Florida in the U.S. district court, in which circuit would an appeal be heard?
Instructions & Grading Criteria (rubric)
Refer to the Grading Criteria before you begin (Instructions), while you are publishing (Expectations), and then again as part of the proofreading/editing process (Rubric/Point Calculations). Do NOT publish a response based on impulse or creativity. Instead, follow the very detailed instructions provided in the Grading Criteria, including the “Response Template.”
Instructional Guidance & Support
Rely on the Student Success Materials for help with research, citations, legal analysis / logical writing, and grammar skills.
Submission Guidelines
Download and save all sources for your records to confirm the use of acceptable sources.
Submit a rough publish through the Self-Assessment Originality Review, make the necessary revisions, proofread, save, and then upload/attach the final publish as a DOC file.
If you upload/attach the incorrect file or experience technical issues, use the second attempt, which will be the one that is graded. No more than two attempts will be provided. Therefore, do not use the second attempt until you are 100% certain that everything is correct and fully functional.
The second attempt is only for submission issues. It is not to be used for resubmitting a revised version after it has been graded. Feedback provided is intended to help students improve on future assignments, not for grade improvement on work that has been submitted and graded.
**ONLY USE BLUEBOOK CITATION, I WILL PROVIDE A FILE ON HOW TO PROPERLY DO SO**** I WILL ALSO PROVIDE THE MAP FOR THE ASSIGNMENT***
Let me know if you need ant help 🙂
