Presented with a hypothetical problem, you will be required to answer questions relating to civil dispute resolution problems arising from the “facts” as presented. There are 8 questions and all will need to be answered as I am not partaking in the Vic Bar Mentoring Program. I have attached the instructions as well as the criteria. Topics will be range from Civil Procedure Law and Jurisdiction, Choice of Forum and Transferring Cases, Originating Process, Service and Appearance, Pleadings and Parties and Joinder.
Full citation will be needed in the AGLC format (Australian Guide to Legal Citation), i have attached the booklet on how this can be completed. Use whatever sources of info you may need.
This is a strict 2000 word limit assessment. So you may go up to 2000 but no more. When you complete the work please compare it to the criteria so it matches the ‘A’ grade. Sometimes questions in Law can be tricky and have hidden meanings so please look closely at what’s being asked.
Something left by the examiners regarding the assessment criteria is “Guided by the High Court’s reasoning in Markarian v R (2005) 228 CLR 357, examiners’ assessments of the assessment tasks will reflect an intuitive synthesis, guided by these criteria, rather than by a model based on fixed weightings for each attribute.” – Do what you will with this information.
